Terms and Conditions for Tampa Bay Buccaneers Football Game Ticket Giveaway

No Purchase Necessary to Enter or Win. A Purchase or Payment of Any Kind Will Not Increase Your Chances of Winning.

1. Eligibility: The Tampa Bay Buccaneers Football Game Ticket Giveaway (the "Giveaway") is open to legal residents of US/FL, who are 18 years of age or older at the time of entry. Employees, officers, and directors of Serotonin South Tampa, LLC, Serotonin Downtown St. Pete, LLC and Serotonin Riverview, LLC, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members (spouse, parents, siblings, and children) and household members of each such employee, officer, and director are not eligible to participate. Void where prohibited.
2. Sponsor: The Giveaway is sponsored by Serotonin South Tampa, LLC located at 3830 W Neptune St. D1, Tampa, FL 33629, Serotonin Downtown St. Pete, LLC, located at 125 2nd Ave N c103 St. Petersburg, FL 33701, Serotonin Riverview, LLC located at 10454 Stelling Dr. Riverview, FL 33578 (the "Sponsor").
3. Agreement to Terms and Conditions: By participating in the Giveaway, entrants fully and unconditionally agree to and accept these Terms and Conditions and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway.
4. Giveaway Period: The Giveaway begins on August 28, 2024 at 9am EST and ends on September 14th, 2024 at 4pm EST (the "Giveaway Period"). Entries received before or after the Giveaway Period will not be eligible.
5. How to Enter: During the Giveaway Period, participants will receive one entry for like, comment and tag and 1 entry for adding to story and 10 entries for coming in to Sertotonin South Tampa located at 3830 W Neptune St. D1, Tampa, FL 33629.
6. Prizes: One winner will receive two (2) tickets to Tampa Bay Buccaneers Football game, scheduled to take place on September 22, 2024 at Tampa Bay Buccaneers Football Stadium. Approximate Retail Value ("ARV"): $800. The prize is non-transferable and no substitution will be made except as provided herein at the Sponsor's sole discretion. The Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.
7. Winner Selection and Notification: The potential winner(s) will be selected in a random drawing conducted by the Sponsor within two days of the drawing on September 14. The odds of winning depend on the number of eligible entries received. The potential winner(s) will be notified via social media and phone call within 2 days of the drawing on September 14. If a potential winner cannot be contacted, fails to provide any requested information within the required time period, or the prize is returned as undeliverable, the potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
8. Publicity: Except where prohibited, participation in the Giveaway constitutes the winner’s consent to the Sponsor's and its agents' use of the winner's name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions: The Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
10. Release and Limitation of Liability: By participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, its affiliates, subsidiaries, officers, directors, employees, Franchisor Serotonin Enterprises LLC, and agents from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use or misuse of any prize. Entrant further agrees that in any cause of action, the Sponsor's liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the entrant be entitled to receive attorneys' fees. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Giveaway.
11. Disputes: Except where prohibited, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Orlando Florida; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
12. Privacy: Information collected from entrants is subject to the Sponsor's privacy policy, which can be found at https://www.serotonincenters.com/privacy-policy/.
13. Winner's List: To obtain a copy of the winner's name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Serotonin South Tampa, LLC, 3830 W Neptune St. D1, Tampa, FL 33629. Requests must be received no later than March 3, 2025.
14. Sponsor: The Sponsor of the Giveaway is Serotonin South Tampa, LLC, Serotonin Downtown St. Pete, LLC and Serotonin Riverview, LLC, 3830 W Neptune St. D1, Tampa, FL 33629.
